These Terms of Service ("Terms") govern your access to and use of GPT Image 2 AI (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. This page is a plain-English draft and will be reviewed and finalized by counsel before general availability.
1. The Service
GPT Image 2 AI provides an interface to generative image models. We route your requests to one or more upstream models, return the results, and give you a history and credit balance to manage usage. Availability, quality, and feature set may change as the underlying models evolve.
2. Accounts
You must provide a valid email and, where applicable, accurate account information. You are responsible for activity that occurs under your account and for keeping your credentials secure. You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction, to use the Service.
3. Acceptable use
You agree not to use the Service to:
- Generate content depicting real, identifiable people without their consent, including deepfakes, impersonation, or non-consensual intimate imagery.
- Generate sexual content involving minors, or any content that sexually exploits or endangers children.
- Generate content that promotes self-harm, terrorism, or the infringement of others' rights.
- Generate content that violates intellectual property rights, including reproduction of copyrighted characters, logos, or artwork in a way that the rightsholder has not authorized.
- Attempt to reverse-engineer, probe, or disrupt the Service, bypass rate limits, or extract model weights.
- Resell or repackage the Service without written permission.
We may refuse, suspend, or terminate access at our discretion when we believe these rules have been broken.
4. Content ownership
Your input. You retain ownership of the prompts, reference images, and other materials you submit to the Service ("Input"). You grant us a limited, non-exclusive, worldwide license to process the Input as needed to operate the Service — including routing it to upstream model providers — and to retain it as part of your generation history.
Your output. To the extent permitted by law and the policies of upstream model providers, you own the images the Service returns to you ("Output"). Note that generative outputs may not be copyrightable in every jurisdiction; we make no warranty that Output is free of third-party rights or that you can register copyright in it.
Our service. The Service itself — the website, interface, code, brand, and anything other than Output — is our property or that of our licensors. Nothing in these Terms transfers those rights to you.
5. Credits and payments
Paid features require credits. Credits are non-refundable except where required by law. We may change pricing with notice; existing credit balances will be honored at their original terms. Failed generations that are our fault will be refunded automatically to your credit balance.
6. Third-party model providers
The Service forwards your requests to upstream model providers. Their usage policies may apply in addition to ours. If an upstream provider rejects a request, we will surface that result to you as a failed generation.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Generative models can produce inaccurate, biased, or otherwise undesirable output; you are responsible for reviewing and deciding how to use Output.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or exemplary damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 100.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we are required to by law. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) will continue to apply.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via the Service or by email before they take effect. Continued use after the effective date constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which we are incorporated, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, subject to any mandatory consumer protections that apply where you live.
